New Grants

The R&D Tax Incentive (RDTI)  performance statistics for the 2021–2022 income year as at June 2023 have been released. The FY22 data presents 12,762 registration representing 14,760 R&D performing entities, of which the total R&D expenditure was $15bn.

There were 11,198 small to medium businesses representing 88% of the program participants. There are 2,607 companies (20.4%) were new to the program.

R&D Tax Updates

The Australian Tax Office (ATO) announced significant developments in the administration and processing of the R&D tax incentive program. In the last quarter of 2023, the ATO released clarification guidelines on the integrity rules that particularly identified issues on the following:

  • R&D expenditure paid to associates
  • who the R&D has been conducted for
  • aggregated turnover $20m
  • overseas expenditure needing advanced findings
  • expenditure not at risk by R&D entity

Another important move was the ATO requirement to publish tax claims from 2024. The information to be published from all R&D tax schedules lodged with the ATO include:

  • the name of the R&D entity
  • Australian business number (ABN) or Australian company number (ACN)
  • the entity’s total expenditure on R&D (known as total notional deductions claimed – label Z in Part A of the R&D tax incentive schedule) less any feedstock adjustments (label B in Part B of the R&D tax incentive schedule)

The R&D Tax Incentive is a self-assessed program where you take full responsibility that your lodged claims are accurate and correct. This, however, does not mean that the ATO will not look into your claimed R&D activities. The tax office will still be looking at your documentations to see how your lodged claims perform against the program’s requirements.
